Radical religious leader Sheikh Abdul Majid al-Zindani, head of al-Iman University and member of the supreme body of the Islah party which rules Yemen, issued a new fatwa on Friday supporting what he called legal criteria, in which he urged Yemenis to reject the documents and outcomes of the National Dialogue and to announce their dissociation from them.

In his fatwa, of which Al-Watan received a copy by mail, Zindani called on President Abd Rabbuh Mansour Hadi and his government not to involve themselves in making decisions in the name of the people of Yemen which diminish their sharia, disrupt their unity, or invite the imposition of what he called foreign guardianship over them and impair their interests and heritage.

Zindani also called upon him to preserve the current constitution and not to permit tampering with it and not to accept any amendments to it except in the manner the constitution itself established for amending its articles, either deleting or adding, and to abide by its covenants with the ulema in regards to allowing legislation from any source other than Islamic sharia, or international agreements which go against sharia or the Islamic religion.

Disruption and guardianship and foreign colonization

After quoting a number of verses from the Qur’an and their exegeses and their bearing on the current reality, Zindani accounted for his fatwa calling on “every Yemeni jealous of his religion, his nation, his future, and the treasures of his country, and his freedom and independence as an individual, in a group or organization or tribe or party or any set-up of components” to denounce and disown the document of the UN envoy Jamal Ben Omar—the Southern Issue Solution Document—and the outcomes of the National Dialogue, considering that the Dialogue’s conference “does not represent the people, and has no right to do so; for it did not come about from elections and the people did not grant it a mandate to publish in our name what would harm us and to adopt in our name a call for foreign domination and submission to new colonization.”

Zindani said, “We, the ulema of Yemen, had issued warning about the formation of the Dialogue conference, and its being put into place under the guardianship of foreign countries eager to achieve their goals and to decree their perceptions and their culture which go against our religion, culture, and values.  The international delegate surprised us by an agreement which destroys our creed and our sharia, just as it destroys our unity and disrupts our nation, and which requires the members of the Conference to sign onto the demands of the Security Council, the United Nations, the countries of the European Union, the states of the Arab League, and others, to interfere in our affairs and impose guardianship upon us by their demanding surveillance, compliance, and insuring the carrying-out of the outcomes of National Dialogue Conference, the first of which is this document to which the ulema of Yemen are responding, and they explained the risks in it in a statement they published.”

He added, “The outcomes of the NDC also included a clear denial of our religion, the foundations of our being, our constants, our unity, our security, our stability, and tears us apart as a land and a people, demolishing our morals, corrupting our homes, destroying our families.  With God’s help, the ulema will have a statement making clear all that has been indicated in its entirety.”

Disbelief, immorality, and hypocrisy

Zindani considered that those who insist on removing constitutional articles related to the Islamic religion and the Islamic sharia, and who demand their abolition or amendment, or its diminishment, fall under the penalty classified by the Qur’an for “hypocrites and the immoral placed in disbelief.”  He added, “This is clear in the stance of those who insist on abolishing what is stated in Article Three of the constitution currently in effect, that Islamic sharia is the source of all legislation.”

He continued, “Those who demand change to Article Three have made clear the partner they want for God in ruling, for they demanded that there be international agreements, covenants, and conventions which do not comply with Islam or its sharia, which permit much of what God has forbidden and forbid much of what God has allowed, dominating the rulings of our Islamic sharia as currently in force in our country.  They have demanded that it be repressed to be in agreement with those international agreements, and such doings, in addition to being contrary to our religion and causing our corruption, it represents an attack on our sovereignty and an interference in our internal affairs, and therefore   of our  independence which is entitled to every country in the world.”

اصدر رجل الدين المتشدد الشيخ عبدالمجيد الزنداني رئيس جامعة الايمان -عضو الهيئة العليا لحزب الاصلاح الحاكم في اليمن - فتوى جديدة يوم الجمعة مدعمة بما قال أنها أدلة شرعية ، حث فيها اليمنيين على رفض وثائق ومخرجات الحوار الوطني، وإعلان البراءة منها.

وطالب الزنداني ,في فتواه -تقت الوطن نسخة منها عبر البريد - طالب الرئيس عبدربه منصور هادي وحكومته بعدم التورط في اتخاذ قرارات باسم أبناء اليمن تنقص شريعتهم أو تمزق وحدتهم أو تدعوا لفرض ما أسماه الوصاية الأجنبية عليهم وتخل بمصالحهم وثرواتهم.

كما طالبه بالمحافظة على الدستور الحالي وعدم السماح للعبث فيه وعدم قبول أي تعديل فيه الا بالطريقة التي أقرها الدستور نفسه في تعديل مواده حذفا أو إضافة, والالتزام بتعهداته للعلماء بعد القبول بأي مصدر تشريع غير الشريعة الإسلامية,أو اتفاقيات دولية تعارض الشريعة والدين الإسلامي.

*تمزيق ووصاية واستعمار اجنبي
وبعد سرد لعديد من آيات القران وتفسيراتها وإسقاطها على الواقع ، برر الزنداني فتواه الموجهة لـ"كل يمني غيور على دينه ووطنه ومستقبله وخيرات بلاده, وحريته واستقلاله فردا أو جماعة أو تنظيما أو قبيلة أو حزبا أو أي تكوين من المكونات " للاستنكار والتبرؤ من وثيقة المبعوث ألأممي جمال بن عمر -وثيقة حل القضبة الجنوبية-ومن مخرجات الحوار الوطني ، على اعتبار أن مؤتمر الحوار "لا يمثل الشعب, ولا يحق له ذلك؛ لأنه لم يأتي عن طريق انتخابات ولا منحه الشعب تفويضا أن يصدر باسمنا ما يضرنا, ويتبنى باسمنا استدعاء الهيمنة الأجنبية والخضوع للاستعمار الجديد".
